CFTC Orders Core Members of Fundsz Fraud Case to Pay Over $30 Million in Fines
The U.S. Commodity Futures Trading Commission (CFTC) has obtained a court ruling in the Fundsz fraud case, requiring defendants Brian Early and Alisha Ann Kingrey to pay over $30 million in fines. The U.S. District Court for the Middle District of Florida issued a default judgment against Early and Kingrey, finding that the two, as board members of Fundsz-related entities and administrators of a Telegram group, made false statements regarding the platform's expected returns, historical trading performance, and investment risks, claiming that user funds could be traded through a "proprietary algorithm" to earn interest. The CFTC noted that when Early and Kingrey learned of the regulatory investigation, they began to downplay previous profit promises and attempted to delete related content from Fundsz's social media. Additionally, the court signed consent orders against two other involved individuals, Rene Larralde and Juan Pablo Valcarce, with Valcarce being permanently banned from representing others in cryptocurrency or precious metals trading and prohibited from further violations of CFTC regulations. The case involves the unregistered Fundsz entities and their website.
