CME CEO Claims Crypto Perpetual Futures Are Swaps, Sues CFTC for Classification
CME Group CEO Terry Duffy asserts that crypto perpetual futures, or perps, should be classified as swaps, which would subject them to stricter regulations. CME is currently suing the Commodity Futures Trading Commission (CFTC) to achieve this classification, despite the CFTC's position that CME can list these contracts independently. Duffy argues that the funding rate, which involves payments between long and short positions to maintain perp pricing, aligns with the definition of a swap. He noted that perps primarily cater to retail investors, while institutional traders account for 94% of CME's first-half volume. CME's complaint claims that Kalshi's perps target retail investors who also utilize CME's offerings. The CFTC's motion to dismiss the case contends that CME lacks legal standing since it can list perps itself. The outcome of the lawsuit could significantly impact how customer collateral is protected and the tax treatment of these products. Duffy expressed concerns about offshore perps offering excessive leverage, while Kalshi CEO Tarek Mansour stated that their perps provide around six times leverage, similar to traditional futures. No ruling has been reported yet, and a dismissal could leave the classification of perps unresolved.
