Is WEEX Legal in Taiwan? FSC VASP Rules and the Public Register

“Is WEEX legal in Taiwan?” cannot be answered responsibly with a simple yes or no. Taiwan’s anti-money-laundering registration and its newer Virtual Asset Service Act licensing framework are different layers. A platform’s presence or absence on a regulator’s list must also be separated from a legal conclusion that it is automatically unlawful. This overview uses Taiwan FSC, Securities and Futures Bureau and statutory material available on 16 September 2026.

What Taiwan's VASP regime requires

The first layer is the AML regime already in force. The FSC’s 5 December 2024 release says Article 6 of the Money Laundering Control Act took effect on 30 November 2024. A business or person providing virtual-asset services must complete AML registration before operating. The covered activities include fiat-to-virtual-asset exchange, virtual-asset-to-virtual-asset exchange, virtual-asset transfers, custody or administration of virtual assets and related control tools, and participation in or services related to issuing or selling virtual assets. Operating without the required registration carries criminal and financial risk; registration is not an optional marketing badge.

The second layer is the Virtual Asset Service Act. The FSC says the Legislative Yuan passed it at third reading on 30 June 2026. Articles 6 and 7 of the text identify seven service categories and require FSC permission and a licence according to the business. The Act also addresses company or branch status, minimum capital, an operating guarantee deposit, customer-asset custody, internal controls, cybersecurity and association membership. Article 56 leaves the commencement date to the Executive Yuan. As of this article’s check, the Act must not be described as already fully effective, and an expected date is not a commencement notice.

  • AML registration: in force, focused on registration and AML/CFT duties.
  • Permission and licence: the Act has passed, but its commencement date is pending; a licence is not the same thing as AML registration.
  • Consumer check: the FSC advises users to consult public information and understand an operator’s services and risks rather than relying on badges or advertising.

Where WEEX appears in the public record

The Securities and Futures Bureau’s Virtual Asset Service Providers page, updated 3 September 2026, displays registered operators, a self-revoked registration and former declaration-regime operators that did not complete the transition. A name-by-name check of the published page did not show WEEX or WEEX International Exchange LTD. The supported statement is therefore that WEEX did not appear on that published list as of its update. That observation alone does not prove that WEEX is illegal, banned or exempt in Taiwan.

The AML Registration Regulation says an overseas virtual-asset provider applying under the Taiwan regime must first complete Taiwan company or branch registration. The new Act also requires an overseas provider establishing a Taiwan branch to obtain FSC permission and a licence. Overseas registrations in another jurisdiction cannot simply substitute for Taiwan registration or a Taiwan licence.

What WEEX says about its own status

WEEX’s Taiwan introduction page lists US FinCEN MSB, Canadian FINTRAC MSB and El Salvador Bitcoin Service Provider registrations as public company disclosures. It explains that an MSB registration is an AML registration, not a full operating licence or prudential supervision, and expressly says the page makes no claim that WEEX holds any Taiwanese authorisation or permit. This is the company’s disclosure, not an FSC approval. An MSB entry elsewhere cannot be presented as a Taiwan licence.

How to check as a Taiwan user

  1. Start with the SFB VASP public page and note the operator name, legal entity and update date.
  2. Record AML registration and Virtual Asset Service Act licensing separately; one is not a substitute for the other.
  3. Read the platform’s terms for jurisdiction, identity verification, account restrictions and asset risks. A Traditional Chinese interface is not proof of Taiwan authorisation.
  4. For “government approved” or “fully compliant” claims, request the regulator, registration type, approval number and date, then check the primary source.

Frequently asked questions

Does absence from the list prove illegality?

No. It supports only the dated observation that WEEX was not shown on the published list. A regulator must assess the facts, service scope and applicable law.

Is an MSB registration a Taiwan licence?

No. It is primarily an AML registration. WEEX’s own disclosure also says it is not a full operating licence or prudential supervision.

When does the Virtual Asset Service Act take effect?

The third-reading date was 30 June 2026, but Article 56 leaves commencement to the Executive Yuan. Use the latest formal FSC and Executive Yuan notices.

A register check is a dated control, not a substitute for reading the legal text. The SFB page can be updated, companies can change names, and a registration can be revoked or replaced. Save the page date and the legal entity you checked. Also distinguish where a service is supplied from where a company is incorporated: a foreign registration may describe the company’s home jurisdiction but does not answer the Taiwan question.

This is why a careful answer may remain conditional. The public register is evidence about the register, while a legal determination depends on the applicable service, entity and facts at the relevant time.
