Memecoin LIBRA: No charges for Javier Milei, Argentine justice sees no fraud

Curtain on LIBRA. "If you go to the casino and lose money, what is the claim?" Javier Milei dismissed complaints in February 2025. Twenty months later, Argentine federal justice agrees with him and dismisses the case of the memecoin LIBRA without any trial.

The dismissal targets eleven people, including the president, his sister Karina, and American Hayden Davis. The criminal case is almost entirely closed for the washed-out buyers within a few hours. Key points of this article:

  • Argentine federal justice has dismissed the case of the memecoin LIBRA without trial, granting a dismissal to figures like President Javier Milei and his sister Karina.
  • The judge concluded that there was no fraudulent maneuver, despite the economic losses suffered by investors, considering that these do not constitute a crime.

LIBRA dismissed for "non-existence of a crime"

Federal judge Marcelo Martínez de Giorgi made his decision on Friday, October 23, 2026, according to court documents consulted by Reuters. He follows prosecutor Eduardo Taiano, who himself requested the general dismissal.

The reasoning is simple. A fraud implies a deceptive maneuver, an error induced in the buyer, and harm caused by this lie. However, the investigation identified no specific false statement that led investors to buy, according to the resolution cited by Infobae.

And what about the presidential tweet from February 14, 2025? The judge admits that Milei's position may have given the launch "a greater impact." But these elements "do not constitute, in themselves, a fraudulent scheme."

The magistrate adds a phrase that every memecoin trader should frame above their screen: an economic loss does not equate, by itself, to a crime.

The political aspect falls with the rest. The Argentine anti-corruption office had already concluded that the message came from a personal account, without public resources. No hidden agreement between Milei and Davis was found.

Karina Milei and Hayden Davis also cleared

Karina Milei's case was based on very little. The only direct document is an entry authorization to the Casa Rosada granted to Hayden Davis in July 2024.

In trader Mauricio Novelli's phone, investigators had found an unsigned draft agreement and a note titled "final agreement," which mentioned a certain "H." For the judge, this unsigned document "lacks documentary value." Nothing proves that it was sent or accepted.

Hayden Davis benefits from the same dismissal. The American businessman presented himself as "launch advisor" for the token. He acknowledged holding nearly 100 million dollars after the crash but denies any wrongdoing.

This amount aligns with the on-chain analyses of the time. Eight wallets linked to the creator had withdrawn about 99 million dollars from the LIBRA market. The Argentine fintech chamber had already mentioned a possible rug pull as early as February 2025, a technique where developers inflate the price with buyers' money before emptying their position.

Memecoin LIBRA: who can still appeal

Not the prosecution. Eduardo Taiano will not contest a decision he himself requested.

The investors who had joined as civil parties were excluded from the procedure along the way. Their direct appeals remain pending before the Federal Court of Cassation, according to Infobae. Without an independent accusation, the case goes to the archives.

On the American side, the trail has also cooled. A federal court in New York rejected in September 2026 most of the class action against LIBRA and Kelsier Labs, Hayden Davis's company.

In Buenos Aires, the presidential camp is savoring. Milei praised the decision on X, and his advisor Santiago Caputo promised that the case would be studied as "the dumbest in history." The opposition, for its part, denounces a "total impunity."

Justice had, however, requested access to the accounts of Javier Milei and his close associates. In the end, none of the eleven accused will have been summoned for a hearing as a defendant.
