Budget 2027: Will we be able to give our Bitcoin at a lower cost?

A six-month window to give more
The 2027 budget proposal includes a more favorable temporary regime for certain family donations. From January 1 to June 30, 2027, donations of money to children, grandchildren, and other beneficiaries specified in the text could benefit from reduced taxation.
During this period, the exemption applicable to certain family donations of money would increase from €31,865 to €50,000. This could be combined with the common allowance of €100,000 between a parent and a child, allowing for the transfer of up to €150,000 without donation tax when all conditions are met.
For holders of Bitcoin and cryptocurrencies, this arrangement may therefore be of interest. However, an essential distinction remains: directly giving BTC is not fiscally equivalent to selling BTC and then transferring the euros obtained.
Accelerating the flow of savings to the young
The measure is included in Article 4 of the finance bill for 2027. The government aims to promote the flow of savings to generations deemed more likely to consume or invest it.
The proposal also includes a temporary rate of 6% for certain donations of money made in full ownership, limited to €100,000 per donor and per beneficiary. The beneficiary must be of legal age or emancipated and under 50 years old at the time of the transfer.
These measures would only apply to donations made during the donor's lifetime and would therefore not alter, in the current wording, the regime applicable to inheritances.
At this stage, they remain provisions of the finance bill. Their implementation will depend on the text finally adopted after parliamentary review.
What this changes for a Bitcoin donation
The increase in the exemption to €50,000 specifically targets donations of money. A donation made directly in Bitcoin, Ether, or another crypto-asset would therefore not benefit from this in the current wording of the PLF, as explained by Gwendal Texier, a member of the Notarial Association of Digital Assets.
Giving bitcoins or ethers is transmitting crypto-assets, not a sum of money. The term "cryptocurrency" should not obscure this difference in nature. A direct donation of these assets does not fall under the exemption raised to €50,000 nor the temporary rate of 6% in the current wording of the bill. The same logic applies to the 6% rate, which is also reserved for donations of money.
Bitcoins transferred directly can, however, benefit from the ordinary allowances applicable to donations. Between a parent and child, the allowance reaches €100,000. Between a grandparent and grandchild, it amounts to €31,865.
These amounts, however, depend on any donations that may have already been made during the fiscal recall period.
