The U.S. Department of Labor has submitted a final rule to the White House Office of Information and Regulatory Affairs for review, which relaxes the inclusion of alternative assets such as private equity, real estate, and cryptocurrencies in retirement plans like 401(k) plans. This rule is nearing completion and is set to be announced soon. The Department of Labor proposed this rule on March 30, aiming to provide a legal "safe harbor" for trustees to include private assets in 401(k) investment options, provided that trustees meet six considerations: performance, fees, liquidity, valuation, performance benchmarks, and complexity. Previously, former President Trump signed an executive order on August 7, 2025, directing the Department of Labor to reassess relevant regulations.
