Token Project Delivery Delays Require Review of Agreements and Dispute Procedures
When a token project fails to deliver tokens as agreed, investors need to review the signed agreements, attachments, amendments, and accompanying letters to confirm the legal entities responsible for obligations, the number of tokens or calculation methods, delivery trigger events, ownership arrangements, and transfer restrictions. The projected launch date announced by the project does not equate to a binding delivery deadline. When tokens have been distributed to other participants, it is necessary to assess whether the delivery obligations have been triggered based on the definitions of token generation events in the agreements, whether investors have fulfilled prerequisite requirements, and the actual actions of the project party. If the project requests an extension of the lock-up period, a reduction in allocation amounts, a change of tokens, or a change in responsible entities, it should be verified whether the contract authorizations and amendment documents include waiver clauses. Investors may retain payment records, transaction hashes, wallet addresses, communication records, and project announcements, and review notification, remedy, negotiation, arbitration, or litigation procedures.
